GIAMPIERO FIORINI SRL reserves the right to change these General Terms and Conditions of Sale repeatedly, so we advise you to read them regularly.
- Acceptance of the general conditions of sale
- The contract stipulated between Giampiero Fiorini S.r.l. and the Customer must be considered concluded with the acceptance, even if only partial, of the order by Giampiero Fiorini S.r.l .. This acceptance is considered tacit, if not otherwise communicated with any modality to the Customer. By placing an order in the manner provided, the Customer declares to have read all the information provided to him during the purchase procedure, and to fully accept the general conditions and payment transcribed below.
- If the Customer is a consumer (ie a physical person who purchases the goods for purposes not related to his professional activity), once the online purchase procedure is completed, he will print or save an electronic copy and otherwise keep these general conditions sale, in compliance with the provisions of the Consumer Code (Legislative Decree 206/05) on distance sales.
- Any right of the Customer to compensation for damages or compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damage to persons and / or property caused by the non-acceptance, even partial, of an order.
- Purchase mode
- The Customer can only purchase the products in the electronic catalog of Giampiero Fiorini S.r.l. at the time of placing the order and viewable online at www.giampierofiorini.it and www.emotivabyfiorini.it as described in the relevant information sheets. It is understood that the image accompanying the description of a product may not be fully representative of its characteristics but may differ in color, size and accessory products in the figure.
- The correct reception and acceptance of the order is confirmed by Giampiero Fiorini S.r.l. by an e-mail reply sent to the e-mail address provided by the Customer.
- In case of non-acceptance of the order, Giampiero Fiorini S.r.l. ensures timely communication to the Customer.
- Terms of payment
- The method of payment (Direct Deposit, Bank Transfer and other payments) will be agreed with the customer after the receipt of the order by Giampiero Fiorini S.r.l .. The customer, as soon as possible, will be contacted by email or telephone contact.
- Right of withdrawal
- Pursuant to Legislative Decree 206/05, if the customer is a consumer (ie a physical person who buys the goods for purposes not related to his professional activity, or does not make the purchase by indicating in the order form to Giampiero Fiorini Srl a reference of VAT number), has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, except as indicated in paragraphs 5.3 and 5.5 below.
- To exercise this right, the customer must send to Giampiero Fiorini S.r.l. a communication to that effect, within 14 working days from the date of receipt of the goods. This communication must be sent by registered letter with acknowledgment of receipt, addressed to Giampiero Fiorini S.r.l. (registered office Via, Po, 41 Parabiago – MI). Once the aforementioned notice of withdrawal has been received, Giampiero Fiorini S.r.l .. will quickly inform the customer of the instructions on how to return. The goods must be returned intact, complete with all its parts and in original packaging (envelopes and packaging), stored and possibly used according to normal care, without any signs of wear or dirt, in compliance with the conditions of the following points 5.3 and 5.5.
- The right of withdrawal is however subject to the following conditions:
- the right applies to the product purchased in its entirety (including the perfectly preserved packaging); it is not possible to exercise withdrawal only on part of the product purchased;
- the right does not apply to audiovisual products or sealed computer software (including those attached to hardware) once opened;
- the purchased good must be intact and returned in its original packaging, complete in all its parts
- according to law, the shipping costs related to the return of the asset are charged to the customer; the costs of delivery to the customer and any other accessory expenses shown at the time of ordering will not be reimbursed;
- the shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer;
- in case of damage to the goods during transport, Giampiero Fiorini S.r.l. will inform the customer of the event (within 5 working days of receipt of the goods in their warehouses), to allow him to promptly report to the courier and obtain the reimbursement of the value of the asset; in this case, the product will be made available to the customer for his return, simultaneously canceling the request for withdrawal;
- upon its arrival in the warehouse, the product will be examined to assess any damage or tampering not caused by transport. If the packaging and / or the original packaging are damaged, Giampiero Fiorini S.r.l. will deduct from the refund due a percentage, however not exceeding 10% of the same, as a contribution to the costs of restoration.
- without prejudice to any restoration costs for damage ascertained to the original packaging, Giampiero Fiorini S.r.l. will refund the customer the full amount already paid, within 14 days from the return of the goods, by procedure of cancellation of the amount charged. In the latter case, the customer will promptly provide the bank details on which to obtain the reimbursement (IBAN code of the invoice).
- The right of withdrawal is totally lost, due to the lack of the essential condition of the integrity of the goods (packaging and / or its content), in cases in which Giampiero Fiorini S.r.l. establishes:
- the non-diligent use of the good that has compromised its integrity, or the use of any consumables;
- the lack of the external packaging and / or the original internal packaging;
- the absence of integral elements of the product (accessories, manuals, parts, …);
- damage to the product for reasons other than transport. In case of forfeiture of the right of withdrawal, the goods will remain at the headquarters of Giampiero Fiorini S.r.l. available to the customer for collection at your expense.
- Guarantees
- All products sold by Giampiero Fiorini S.r.l. they are covered by the manufacturer’s standard warranty and the guarantee for conformity defects, pursuant to Decree 24/02. To use the warranty, the customer must keep the warranty coupon in the original packaging, as well as the bill issued Giampiero Fiorini S.r.l.
- In the event that, for any reason, it is not able to provide its customer with a product under warranty (restored or replaced), Giampiero Fiorini S.r.l. may at its discretion proceed with the return of the amount paid taking into account the use of the good or its replacement with a product of equal or higher characteristics.
- The times of repair or possible replacement of the product depend exclusively on the policies of the manufacturer and no damage can be requested to Giampiero Fiorini S.r.l. for any delays in carrying out repairs or replacements.
- In cases where the application of the guarantees provides for the return of the product, the goods must be returned by the customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment); to limit damage to the original packaging, we recommend placing it in a second box; in all cases, the affixing of labels or adhesive tapes directly onto the original packaging of the product should be avoided.
- Privacy
- The personal data requested when placing the order are collected and processed in order to meet the express requests of the customer and will not under any circumstances and for any reason transferred to third parties. Giampiero Fiorini S.r.l. guarantees its customers compliance with the law on the processing of personal data, governed by the privacy code referred to in Legislative Decree 196 of 30.06.03 and by Regulation (EU) no. 2016/679 – GDPR (General Data Protection Regulation)

- Complaints

- Applicable law
The sales contract between the customer and Giampiero Fiorini S.r.l. it is concluded in Italy and regulated by Italian law.
